END USER LICENSE AGREEMENT (EULA)

Introduction

This End User License Agreement (« Agreement ») is a legal agreement between you (« User ») and Skills Issue Entertainment (« Company », « we », « our ») regarding the video game UNDER US (« Game »).

The Game is developed and published by Skills Issue Entertainment.

By downloading, installing, accessing, or playing the Game, you agree to be bound by this Agreement. If you do not accept these terms, do not install or use the Game.

Related documents. This Agreement applies together with the following documents, which form part of the contractual framework governing your use of the Game: the Server Rules, Modding Guidelines, Privacy Policy, Content Creator License, Workshop Policy, and Dedicated Server License, where they apply to your use. These documents are available on the Game's official website (https://under-us.com/). In the event of any conflict between this Agreement and any of these documents on a specific point, this Agreement shall prevail, unless the relevant document expressly provides otherwise.

Part I – License and Intellectual Property

1. Grant of License and Use

Skills Issue Entertainment grants you a limited, non-exclusive, revocable license to install and use UNDER US for personal, non-commercial purposes.

The Game is licensed, not sold.

• Platforms: The Game may be distributed via Steam and Epic Games Store.
• Restrictions: You may not redistribute, sell, decompile, or extract the Game's assets without authorization.

2. Intellectual Property

All rights, title, and interest in and to the Game, including but not limited to the code, gameplay systems, visuals, characters, creatures, music, and trademarks, belong exclusively to Skills Issue Entertainment or its licensors.

Part II – Conduct and User Content

3. Conduct and User Content

3.1 Online Conduct

By accessing multiplayer services, you agree not to:

• cheat or use unauthorized software or devices;
• harass, intimidate, or harm other players;
• disrupt online services or others' experience;
• use unauthorized third-party software (bots, cheats, etc.).

The Company may use automated anti-cheat systems.

3.2 Exploitation of Bugs and Exploits

The intentional exploitation of bugs or exploits in the Game to gain an unfair advantage is strictly prohibited. Such conduct may result in sanctions, including temporary or permanent account suspension, loss of progression, or any other measure the Company deems appropriate to preserve the integrity of the Game and fairness among players.

3.3 Suspension and Termination

Skills Issue Entertainment reserves the right, in its sole discretion, to suspend, restrict, or terminate a user's access to the Game or online services, with or without notice, if the user violates the Game's rules, this Agreement, or engages in conduct harmful to the community.

The Company may also take any measure necessary to protect the integrity of the Game and its services. Decisions regarding sanctions are final and do not require detailed justification beyond what is provided for by the Company's policy or applicable law.

3.4 Modding Policy

Creating mods is permitted and encouraged. However:

• mods must not contain illegal content;
• mods must not be monetized without prior written authorization;
• mods must not redistribute the base game.

By publishing a mod, you grant Skills Issue Entertainment a worldwide, perpetual, royalty-free license to use, modify, distribute, or integrate that content into the Game.

3.5 User-Generated Content

The Game may allow the creation of content by players (constructions, bases, creations, or other elements). By creating such content, you grant the Company a worldwide, royalty-free license to use or exploit that content in the Game.

Part III – Service and Game State

4. Service Management and Game State

4.1 Server Resets (Wipe)

For technical, maintenance, or gameplay balancing reasons, the Company reserves the right to reset player progression, characters, bases, or game worlds.

4.2 Service Closure or Modification

Skills Issue Entertainment reserves the right to modify, suspend, or discontinue the Game's online services at any time. The Company is not obligated to maintain the Game or online services for any specific period; it may discontinue them at any time in accordance with these terms.

4.3 Early Access

If the Game is distributed in early access, you acknowledge that it may contain bugs, incomplete features, and that certain systems may be modified before the final release.

4.4 Modification of the Game

Skills Issue Entertainment reserves the right to modify, remove, or add features, content, gameplay mechanics, or systems at any time as part of the development or evolution of the Game.

Such changes may affect progression, items, resources, bases, or the game experience in general. Purchasing or using the Game does not grant any right to a particular version or set of features; the Company is not obligated to maintain any specific feature because a user may have purchased the Game for that feature.

4.5 Virtual Items

All items, resources, virtual currency, constructions, bases, or any other elements obtained or created in the Game are virtual items with no real monetary value. They may not be exchanged for real money outside any official mechanisms that the Company may provide.

Users acknowledge that these elements remain the property of Skills Issue Entertainment and may be modified, removed, or reset at any time, without notice or compensation, in accordance with these terms and the Game's rules.

4.6 Purchases and Refunds

Purchases of the Game or additional content (if any) are made through distribution platforms (Steam, Epic Games Store, etc.). Refund requests are governed exclusively by the refund policy of the relevant platform (Steam, Epic Games Store, etc.) and by the laws applicable in your jurisdiction. Skills Issue Entertainment is not obligated to grant refunds beyond what the platform or the law provides.

5. Updates

Updates, patches, or new versions of the Game may be released. Users may be required to install these updates to continue using certain features, including online services.

Part IV – Content Creation and Data

6. Content Creation and Streaming

Skills Issue Entertainment allows players to create and share content featuring the Game, including:

• gameplay videos;
• live streams;
• tutorials or reviews.

Such content may be monetized on platforms such as YouTube or Twitch provided it does not infringe the rights of the Game or third parties. For extended commercial use or a specific license, see the applicable terms (e.g. Content Creator License).

7. Privacy and Personal Data

Use of online features may involve the collection of certain technical information, including:

• account identifiers (Steam or Epic);
• game statistics;
• server connection logs.

This information is used to operate online services, improve the game experience, and ensure server security.

Part V – Eligibility

8. Minimum Age

The Game is intended for users aged 13 years or older. You must be at least 13 to access or use the Game, unless the law or rating in force in your country (e.g. PEGI, ESRB or equivalent) requires a higher age, in which case you must comply with that minimum age.

If you are a minor in your jurisdiction, you represent that you are using the Game with the consent of a parent or legal guardian, who accepts the terms of this Agreement on your behalf and is responsible for your use of the Game.

Skills Issue Entertainment reserves the right to restrict or suspend access to the Game if these age requirements are not met.

Part VI – Liability and Indemnification

9. Indemnification

You agree to indemnify and hold harmless Skills Issue Entertainment from any claim, loss, or damage arising from your use of the Game or your content (mods or creations) that violates applicable laws or third-party rights.

10. Limitation of Liability

The Game is provided « AS IS » and « AS AVAILABLE ».

Skills Issue Entertainment does not warrant that the Game will be error-free or that services will be available at all times.

The Company shall not be liable for:

• loss of progression, data, or virtual items;
• indirect or consequential damages;
• service interruptions or changes made to the Game.

Force majeure. The Company shall not be liable for any delay, interruption, or inability to provide the Game or online services resulting from events beyond its reasonable control (force majeure), including but not limited to: natural disaster, war, civil unrest, pandemic, major failure of infrastructure or providers (hosting, platforms), acts of public authorities, or any similar event.

Part VII – Disputes and Applicable Law

11. Jurisdiction

Any dispute arising from this Agreement shall be submitted to the courts of competent jurisdiction located in Montreal, Quebec, Canada.

12. Governing Law

This Agreement is governed by the laws of the Province of Quebec, Canada, without regard to conflict of law rules.

Part VIII – Modifications and General Provisions

13. Modifications to the Agreement

Skills Issue Entertainment may modify this Agreement at any time. Updated versions will be published on the official website: https://under-us.com/

Continued use of the Game after modifications are published constitutes acceptance of those modifications. If you disagree with the modifications, you may stop using the Game and, where applicable, exercise your right of withdrawal in accordance with the platform's policy (Steam, Epic, etc.) and applicable law.

14. General Provisions

• Entire agreement: This Agreement, together with the documents to which it refers (Privacy Policy, Game rules, etc.), constitutes the entire agreement between you and the Company regarding the Game.
• Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in effect.
• No waiver: The Company's failure to exercise any right under this Agreement shall not constitute a waiver of that right.
• Language: This Agreement may be offered in multiple languages. In the event of any conflict or ambiguity between the French and English versions, the English version shall prevail.
• Assignability: Skills Issue Entertainment may assign or transfer this Agreement, or the rights and obligations under it, to a third party (e.g. in the event of a sale of the Game, the Company, or part of its assets). The User may not assign or transfer their rights under this Agreement without the prior written consent of the Company.
